File noting exposed UPA attempt to frame Amit Shah in Sohrabuddin Sheikh case: Arun Jaitley

NEW DELHI: BJP on Tuesday celebrated the order of a Mumbai special court discharging Amit Shah in the case concerning his alleged complicity in "encounter" of Sohrabuddin Sheikh and Tulsi Prajapati, as vindication of their stand that the CBI’s chargesheet against the party chief was part of the conspiracy to implicate Prime Minister Narendra Modi while demanding an apology from Congress chief Sonia Gandhi.

Recalling that he "among the few" who maintained for 3 years that CBI’s case against Shah was a frame-up and was based on "no evidence", finance minister Arun Jaitley said charges were filed against Amit Shah at the behest of the previous regime, emphasizing that one vital noting on CBI file gave the game away. The noting had clearly said that the framing Shah was essential for implicating Modi, then the CM of Gujarat. He also said that while CBI’s own legal department had opposed the arrest, it was overruled by Ashwani Kumar.

"Shockingly, when the legal department of the CBI opined that there was no case against Shri Amit Shah, the same was responded to by the supervisory officer of CBI, putting up a "Note" by observing that the arrest of Amit Shah would enable the CBI to get some more witnesses particularly the police officers since they would then feel intimidated. He also opined that arresting Amit Shah was necessary since it was necessary to reach the eventual target of investigation of Narendra Modi. This note was approved by the Director, CBI, Shri Ashwani Kumar," Jaitley wrote on his Facebook.

Jaitley’s cabinet colleague, telecom minister Ravishankar Prasad, also applauded the special court for nailing the political conspiracy against Shah. "Justice has prevailed," said Prasad, claiming that the case against Shah was based on hearsay and marked ‘vendetta politics’.












Sohrabuddin case: Amit Shah’s rollercoaster journey

BJP demanded an apology from Congress chief, with the party secretary Shrikant Sharma saying that the case against Shah was an "odious political crime".

The finance minister, who praised the judiciary for its independence and criticized the CBI for allowing itself to be misused, elaborated on his "frame-up" charge by emphasizing that Shah, then the minister of state for home in Gujarat, was sought to be falsely implicated in the case despite the fact that encounter of Sohrabuddin, a notorious gunrunner who was wanted by police in Gujarat, Rajasthan and Madhya Pradesh, was directed by Intelligence Bureau(IB) which works under the Centre. He said in such cases it is the IB which develops intelligence and tracks the target. Jaitley, who protested to former PM Manmohan Singh against Shah’s arrest, said police of states were brought into the picture only when the IB concluded that it was possible to arrest Sohrabuddin who was charged under TADA after Madhya Pradesh police recovered 40 AK- 56 rifles and hundreds of cartridges from his premises in Ujjain district.

Significantly, Jaitley also dwelt on the roles of law officers of UPA after Sohrabuddin’s brother approached the Supreme Court to demand a probe into the encounter. The finance minister said the then additional solicitor general "in a pre-conceived and planned move" appeared in the case on the very first day to volunteer to take instructions for the Centre. Gopal Subramaniam went on to "designate himself" as the amicus curiae in the case even when court had not appointed him. The then Attorney General made it a point to attend each hearing even when case did not concern the Centre in a formal way.

Jaitley further said even though the SC after hearing amicus curiae Subramaniam handed over the investigation to CBI on the ground that the case had inter-state ramifications there. CBI never probed the angle concerning Andhra Pradesh which was then ruled by Congress.

The finance minister also said CBI’s case against Shah was built on the fake testimony of two known land grabbers –Ramanbhai Patel and Dashrathbhai Patel– with criminal antecedents who were later felicitated at a function presided over by Congress leader Shankersinh Vaghela. Jaitley said the two witnesses against Shah had alleged that they were asked to pay Rs 75 lakh to the BJP chief in order to secure their release from preventive detention, whereas the fact was that the conduit through whom Shah allegedly collected money in three installments was not present in India on any of the three dates mentioned by them.

When the Gujarat HC granted Shah bail saying that there was no evidence against him, CBI challenged the order in SC which asked the BJP chief to stay out of Gujarat as a condition for bail.

Jaitley said Shah was made an accused in the case concerning the "encounter" of Tulsidas Prajapati merely because he was in telephonic contact with one of the accused police officers. Jaitley said Shah as home minister was required to be in touch with the police officer R K Pandian and yet the CBI not just arrested him but tried to drag the case despite the SC order to wrap it up in six months from November 21. CBI delayed filing the chargesheet until September 2012 so that Shah could be arrested before the assembly elections.

Also, while CBI initially told the SC that Prajapati case was an extension of one arising from the "encounter" of Sohrabuddin, it changed its stand to file a separate chargesheet merely to keep Shah in jail- a move which was thwarted by SC.

Jaitley also said CBI had also framed another senior BJP leader, Gulab Chand Kataria, former home minister of Rajasthan, in the Prajapati case. He said CBI’s case was exposed when Kataria produced evidence to show that he and his wife were not present in Rajasthan on the day when he was accused of meeting Gujarat "encounter" cop D G Vanzara at a Udaipur guesthouse to plot Prajapati’s "encounter".

manufactured in Japan as a trial. In the specifications, they set standard that they will accept only three defective pieces per 10,000 pieces.

When the delivery came to IBM there was a letter accompanying it.

"We, Japanese people, had a hard time understanding North American business practices. But the three defective parts per 10,000 pieces have been separately

You know recently when Ukraine was going through a civil conflict it was in the papers everyday. Countries were condemning Russia, sanctioning it, trying to support the country being ravaged, sending in aid money, food, etc.

But then I saw a piece in the paper where Ukrainians said, we don’t want aid. We don’t have much right now, and that’s ok. We will manage. Homes destroyed, livelihoods wiped out, but we will manage. What we want is peace. We cannot live without peace. That is all they asked of the international community.

All the money in the world cannot replace a feeling of peace. It is why millionaires are chasing after life coaches, Richard Gere came to India to connect with the Dalai Lama, Tom Cruise adopted scientology, Deepak Chopra is a celebrity guru, and obviously over here we all have our personal favourite swamis, babas and gurujis.

We all really just want a little a little piece of peace.

Peace of mind. We are willing to give away vast amounts of wealth for it. But often we lose it while chasing massive amounts of wealth. An odd situation.

This got me wondering what else I’m losing everyday that I will one day wish I could pay to get back.

Health, the greatest of wealths

Right now, as I sit here typing this out, I’m trying to ignore a mild throbbing in my upper back. You could pay me a million rupees for this article or you could say I’ll take away that niggling pain from your back, and I would choose the latter.

Physical pain and discomfort can just ruin the joy of little things… every day things. I write for a living but sitting here at a computerwriting everyday is slowly killing me.

This is something money can’t fix. I’d pay someone to fix it but they can’t.

Love, it’s quite the drug

Do you know why Mark Zuckerberg, the man who invented Facebook, invented it? Not to get rich or famous orbecome an entrepreneur. He was in love with a girl and he wanted to get her attention.

Your motivation for everything you work for – success, money, security, is probably the same. You do it for the love of your family. But are you valuing this love enough?

Parents who work long hours and are unable to spend enough time with their children say, ‘I did it to give you everything you would ever need or want in life. I did it for you.’

But what children, and spouses, and loved ones really need is more time together. Maybe sacrifice a little of that time and money, to give more space in your life to love. I promise it’ll be worth your while, it’s one thing worth more than money.

The unforgiving ticking of time

Time is unforgiving. Once past, it can never be brought back. And yet, we are often far more careless with our time than with our money. We think twice about spending money, analysing expenses with complex precision, make sure we get value for every rupee … we are quite the paisa vasool culture.

But we throw time around as though it is an unlimited resource. It is not.

Ask the parent who didn’t pay enough attention to his child, now a sullen teenager uninterested in being seen with his parents. Ask the athlete who feels the end of his career nearing, no longer young enough to be at the top of his game. Ask the woman who spent one too many years chasing career goals, and missed the deadline for bearing a child.

Time, once past, can never return. Give it due respect.

Experiences and the memories they birth

Do you remember the last time you caught up with your old college pals. What did you guys talk about? I’m guessing there was a series of anecdotes starting with the words, ‘Remember when…

Arre yaad hai (remember) when we snuck out of the hostel and jumped over the walls into the library at night and rearranged all the books? Or whatever masti and tomfoolery you were up to those days…

You didn’t talk about how much you make or what you own. Yes, you carry around your sleek gadgets and perhaps show a thing or two off, maybe even throw in the brand of your new car into conversation.

But that’s not what really brings you to the pure hearty laughter that a ‘remember when…‘ story can bring. The memories of those ‘college ke din‘ are irreplaceable. The memories from your honeymoon, the first time your child said mama, the first time you jumped into the deep blue ocean with an oxygen tank and discovered you could breathe under water… priceless.

And it’s not just me saying that. Psychological research suggests that when you spend money to buy things the happiness you derive from them is short-term. But when you spend on experiences, the memories that are created give you a lifetime of happiness.

Bus yaadein reh jaati hai … memories live on… so go ahead create some more… they are more important than money.

Personal Satisfaction

‘A job well done is its own reward,’ the saying goes.

One of the greatest incentives that drives us is striving to be the best. Bonus and remuneration are nice incentives, the need for money keeps us going, motivates us to do a good job. But it doesn’t drive us to greatness. That is something that comes from within – the need to achieve mastery.

As Mahatma Gandhi said. ‘Infinite striving to be the best is man’s duty; it is its own reward.’

We can see this in some of the leaders of our society. Azim Premji, the founder of Wipro, recognized nationwide for being a simple man, clearly didn’t do it for the money. Narayana Murthy, another captain of industry, believes in ethical business. ‘A clear conscience is the softest pillow in the world,’ he is known to have said.

Personal satisfaction from doing the best job you can, from doing the right thing, and giving it your all, is worth more than money (even if money is always a nice added bonus).

Common Sense

Ok obviously, since what I do is peddle common sense I think it’s more important than money. But you have to admit, it has great value. It teaches you to deal with whatever situation life throws at you. But since I’m always writing to you about it I won’t go on and on here.

So that’s my list of things that matter more than money. I’m not trying to under value money. It is crucial to provide the foundation of a good life. But it’s really just the means to an end. That end is happiness. And this is a list of things that bring lasting happiness.

Live In The Present, Free Of EgoA colleague went to Andaman & Nicobar on holiday with his wife and child. Next day his wife died of a heart condition. When I phoned him to console him, his first sentence was, ‘There is no God’, followed by, ‘It’s my fault’.

In extreme pain faith gets shaken and we take the entire burden of blame on ourselves. I too had chosen to sleep at night when my father was coughing incessantly while my mother took him to the hospital and soon i received the devastating call saying he had left us. Years have passed but whenever i recall this i blame myself. I could not forgive myself. I tried immersing myself in rituals, meditation, pilgrimages, worship, but the only place i found answers was in the Gita.

When Krishna tells Arjuna, “All actions are done by the qualities of nature only, He whose mind is deluded by egoism thinks: ‘I am the doer’” (3.27), it comes as a big relief. ‘I am the doer’ is like confessing to a crime which can either produce guilt or pride and will certainly reinforce the idea that ‘I am the body ‘and crush us in the wheel of birth and death. Krishna wants us to see that actions and thoughts are influenced by Nature.

Nature works through three gunas – sattva, rajas and tamas — which sway our actions and thoughts. Gunas come to us due to our samskaras, consistent habits, and if we do not make the effort to uplift them to saatvik level they become part of our personality and we consider them natural. So either we can change them by selfless action, meditation, worship, positive thinking and living in the present or by completely surrendering all actions to Krishna with love. Krishna means the Supreme Self, the eternal Divine.

Ego of doer-ship strengthens identification with body, mind and senses which leads to accepting its good and bad results, too. Identifying with body, mind and senses is ignorance as it takes away attention from soul and brings with it ego, desires, depression, mental weakness and ultimately our downfall. Krishna says, ‘Renouncing all actions in Me, with the mind centred in the Self, free from hope and egoism, and from (mental) fever, do you fight’ (3.30). Renunciation is giving up fruits of actions, with mind immersed inwardly in remembering the Eternal, free from hope of future and ego of past, without mental weaknesses, performing righteous actions. One way of surrendering is by offering all actions to the Supreme by saying, ‘Sri Krishna arpanamastu,’ while another way is to let the ego be proud that it now belongs to the Lord, ‘Asa abhimaan jaaye nahi bhore, Mein sewak, Raghupati pati more’(Sri Ramacharitmanas). Rama’s devotee Suteekshana admits that the ego is like a serpent which will raise its poisonous head so why not teach it to be proud of being the Lord’s humble servant? Thus ego’s taamsik guna of pride becomes saatvik, as positive pride. An intimate relationship of the seeker with God is built which is saatvik and will not result in bondage as desires are removed.

Wise is he, who, disconnecting himself from body, mind and sense organs, identifying himself with Atman, sees that senses are functioning according to gunas while the Self is action-less, and escapes the burden of karmas. Unwise is he who imagines that he is doing the action. In life, usually the scene is tough to handle but being instruments of God we have no choice but to participate in this big cosmic drama. Thankfully, free will means we can progress from taamsik to saatvik.

1- Learning new things: Gaining more and more knowledge increases the wisdom level by giving you insightful depth in the field of your interest. Whether you are a professional, a businessman, student or a house wife you must learn new things in order to enhance your mental horizons and improving your life standards. You can do this by getting trainings, earning a new degree or certificate, subscribing to online communities or reading books.

2- Achieving Mental & Spiritual Heights: This one is my favorite asMental peace and mental prosperity is the most critical aspect of life regardless of the financial situation. Even if you are rich, if you don’t have mental peace, you are missing a great blessing so you must work on the techniques to attain a humble and stable mind. This can be achieved by attaining positive personality, by having better control on Anger, by beingless Reactive, and by avoiding Stress.

3- Financial Targets: Most of us work on this target all year round. However we do not strategize enough to achieve it. Primarily we spend a lot of money on our wants instead of our needs. A careful analysis must be done before you spend on anything. Read this article for making good decision. Being too much materialistic and having the lust of acquiring more and more things, even if we don’t use them, takes us away from simple life which ultimately add extra layer to the complications in our lives . With everyone busy on his smart phones, PDAs, laptops and Television we have almost killed the family union spirit which is adding complications in relationships resulting in serious consequences.Strong family bonding are an indicative of better happiness index. People who spend less time with families are comparatively less happier. Make a resolution this year to become a family guy. Spend time with them, spend money on family fun activities and you will feel a special mental peace eventually.

8- Getting Organized: Staying organized has many advantages in terms of having more time for yourself and family; in terms of saving money; peace of mind, better health, balanced life and improved professional/Social life. This involves being organized in terms of time, in terms of office desk, official work, differentiating between urgent and important tasks and organize them, maintaining a personal diary, maintaining a list of things-to-do.

9- Helping Others: Not a lot of people focus on this but I would really appeal you to consider this. Charity Services are the tax we pay back to society for living on earth. Almost all of the religions emphasize to its followers to take care of people around them. For a couple years I ‘ve been blaming it on lack of sleep and too much pressure from my job, but now I found out the real reason: I’m tired because I’m overworked.
The population of this country is 237 million. 104 million are retired. That leaves 133 million to do the work. There are 85 million in school, which leaves 48 million to do the work. Of this there are 29 million employed by the federal government, leaving 19 million to do the work. 2.8 million are in the Armed Forces, which leaves 16.2 million to do the work. Take from the total the 14,800,000 people who work for State and City Governments and that leaves 1.4 million to do the work. At any given time there are 188,000 people in hospitals, leaving 1,212,000 to do the work. Now, there are 1,211,998 people in prisons. That leaves just two people to do the work.
You and me.
And you’re sitting at your computer reading jokes.
